General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (hereinafter "GTC") apply to all contracts between

(hereinafter "Provider") and the Customer (hereinafter "Customer") regarding the provision of digital content (e-books, video courses) and services (1-on-1 sessions) via the website www.anxietysupporthub.com.

Deviating conditions of the Customer shall not be recognized unless the Provider expressly agrees to their validity in writing.

2. Contract Partner and Conclusion of Contract

2.1 Contract Partner

The purchase contract is concluded with RITZI GmbH.

2.2 Conclusion of Contract

The presentation of products on our website does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

By clicking the button "Buy now" or "Order with obligation to pay", the Customer submits a binding offer to purchase.

The Provider confirms receipt of the order by email (order confirmation). This order confirmation does not yet constitute acceptance of the contract.

The contract is only concluded upon:

  • The activation of access to digital content (e-books, video courses), or
  • The confirmation of the booked session appointment via email.

2.3 Storage of the Contract Text

The contract text is stored by the Provider. The Customer receives an order confirmation by email containing all order details.

2.4 Contract Language

The language available for the conclusion of the contract is German.

3. Scope of Services

3.1 E-Books

E-books are digital documents in PDF format that are available for download after purchase or accessible via the Memberspot membership platform.

  • Scope: One-time access to the e-book, download option (if technically provided), no time limit on access as long as the Provider operates the platform.
  • System Requirements: PDF reader (e.g., Adobe Acrobat Reader), internet connection for platform access, current browser version.

3.2 Video Courses

Video courses consist of recorded video lessons that can be streamed via the Memberspot platform.

  • Scope: Access to all videos included in the course, access to accompanying materials (if included), no time limit on access as long as the Provider operates the platform, no download of videos (streaming only).
  • System Requirements: Stable internet connection, current browser with HTML5 support, sufficient bandwidth for video streaming.

3.3 1-on-1 Sessions

1-on-1 sessions are individual online conversations via Zoom.

  • Scope: A session lasts 60 minutes (unless stated otherwise), conducted via Zoom, appointment booking via Motion, no recording (unless explicitly agreed).
  • System Requirements: Stable internet connection, functioning microphone and camera, Zoom client or browser access, quiet environment.
Important Note: The 1-on-1 sessions serve as advice and support for anxiety management but do not constitute medical or psychotherapeutic treatment. In case of mental illness, please consult a doctor or psychotherapist.

4. Prices and Payment Terms

4.1 Prices

All stated prices are final prices and include the statutory Value Added Tax (VAT).

The prices apply at the time of the order. Price changes remain reserved.

4.2 Payment Methods

Payment is processed via the payment service provider Stripe. The following payment methods are accepted:

  • Credit Card (Visa, Mastercard, American Express)
  • Debit Card
  • SEPA Direct Debit (if available)
  • Other payment methods supported by Stripe

4.3 Due Date

The purchase price is due immediately upon conclusion of the contract.

Access to digital content or the execution of the session will only be granted after full receipt of payment.

4.4 Default of Payment

In the event of default of payment, statutory regulations apply. The Provider is entitled to charge default interest at a rate of 5 percentage points above the base interest rate (for consumers) or 9 percentage points above the base interest rate (for entrepreneurs).

5. Provision and Access

5.1 E-Books and Video Courses

After successful receipt of payment, the Customer receives:

  • An email with access data for the Memberspot platform.
  • Access to the purchased content via their personal customer account.

Access is usually activated within 24 hours after receipt of payment.

5.2 1-on-1 Sessions

After booking and receipt of payment:

  • The Customer receives an appointment confirmation via email.
  • The Zoom link for the session will be sent (at the latest 24 hours before the appointment).
  • The Customer can manage the appointment via Motion.

Cancellations:

  • Free cancellation up to 48 hours before the appointment.
  • Cancellation less than 48 hours before the appointment: no refund.
  • No-show: no refund.
  • Rescheduling is possible upon consultation.

6. Usage Rights and Copyright

6.1 Granting of Usage Rights

With the purchase, the Customer acquires a simple, non-transferable, non-sublicensable right to use the digital content exclusively for personal, non-commercial use.

6.2 Prohibited Use

The following actions are prohibited:

  • Reproduction, distribution, or making content publicly available.
  • Passing on access data to third parties.
  • Uploading to file-sharing platforms.
  • Commercial use.
  • Editing or modification of the content.

6.3 Copyright Infringements

In case of violation of the terms of use, the Provider reserves the right to:

  • Block access.
  • Claim damages.
  • Initiate legal steps.

All content (texts, videos, graphics) is protected by copyright. The rights belong to RITZI GmbH or their licensors.

7. Availability and Technical Issues

7.1 Availability

The Provider strives to provide the platform with an availability of 98% per year. Excluded are times when the platform is unreachable due to technical problems, maintenance work, or force majeure.

7.2 Maintenance Work

Planned maintenance work will be announced in advance if possible.

7.3 Technical Problems

In case of technical problems, the Customer can contact support at [email protected].

7.4 Disclaimer

The Provider is not liable for:

  • Internet disruptions on the Customer's side.
  • Incompatibility with outdated browsers or systems.
  • Data loss on the Customer's side.
  • Interruptions due to force majeure.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal. Details can be found in the separate cancellation policy below.

Important Note: For digital content (e-books, video courses), the right of withdrawal expires prematurely if the Customer has expressly agreed that the execution of the contract begins before the expiry of the withdrawal period, and has confirmed their knowledge that they lose their right of withdrawal by consenting to the beginning of the execution.

9. Warranty

9.1 Statutory Warranty

Statutory warranty rights apply.

9.2 Material Defects

Digital content is considered defective if it does not have the agreed quality or is not suitable for ordinary use.

In the case of justified notices of defects, the Customer is initially entitled to supplementary performance (rectification).

9.3 Notification of Defects

Defects must be reported immediately via email to [email protected].

9.4 Exclusion

No defect exists in case of:

  • Deviations based on the display of the Customer's devices/browsers.
  • Problems due to outdated software or hardware of the Customer.
  • Improper use by the Customer.

10. Liability

10.1 Liability for Intent and Gross Negligence

The Provider is liable without limitation for intent and gross negligence as well as under the Product Liability Act.

10.2 Liability for Slight Negligence

In case of slight negligence, the Provider is liable only:

  • For injury to life, body, or health.
  • For breach of essential contractual obligations (cardinal duties).

In case of breach of essential contractual obligations, liability is limited to the contract-typical, foreseeable damage.

10.3 Exclusion of Liability for Content

The Provider assumes no liability for:

  • The accuracy, completeness, or timeliness of the provided information.
  • Decisions made by the Customer based on the content.
  • Health consequences resulting from the application of the content.

Important: The content serves exclusively for information purposes and does not replace professional medical or therapeutic treatment.

10.4 Liability for External Links

The Provider assumes no responsibility for content of external websites linked to.

11. Data Protection

The processing of personal data takes place in accordance with our Privacy Policy, which is available at www.anxietysupporthub.com/datenschutz.

12. Dispute Resolution

12.1 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

12.2 Consumer Arbitration Board

We are not willing or obliged to participate in dispute settlement proceedings before a consumer arbitration board.

13. Final Provisions

13.1 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies insofar as no mandatory statutory provisions of the state in which the consumer has their habitual residence are restricted.

13.2 Place of Jurisdiction

If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Provider is the registered office of the Provider.

13.3 Severability Clause

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.

Cancellation Policy for Consumers

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us

by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but it is not mandatory.

To observe the withdrawal period, it is sufficient that you send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Special Notes

Premature Expiration of the Right of Withdrawal for Digital Content

Important: Your right of withdrawal expires prematurely if:

  1. You have expressly agreed that we begin the execution of the contract (provision of e-books/video courses) before the expiry of the withdrawal period, AND
  2. You have confirmed your knowledge that you lose your right of withdrawal by consenting to the beginning of the execution.

This consent is obtained from you before the order is completed.

Right of Withdrawal for Services (1-on-1 Sessions)

The right of withdrawal expires prematurely for services if:

  1. The service has been fully performed, AND
  2. The execution began with your express consent, AND
  3. You have acknowledged that you lose your right of withdrawal upon complete fulfillment of the contract by us.

Practical significance: Once a 1-on-1 session has been conducted, withdrawal is no longer possible.

If you wish to cancel a booked session, the cancellation conditions from the GTC apply (free cancellation up to 48 hours before the appointment).
